General Terms and Conditions (GTC)
1. Scope of application
These General Terms and Conditions (hereinafter referred to as “GTC”) apply to all contracts concluded between [your name/company name] (hereinafter referred to as ‘Provider’) and the customer (hereinafter referred to as “Customer”) via this website. By placing an order or using a service, the customer accepts these GTC.
2. Conclusion of contract
The presentation of the products/services on the website does not constitute a legally binding offer, but rather an invitation to place an order.
The contract is concluded when the provider accepts the order by sending an order confirmation by email or delivers the goods/services.
3. Prices and terms of payment
All prices are in Swiss francs (CHF) and include statutory value added tax (if applicable).
Shipping costs, if applicable, are shown separately.
Payment is made using the payment methods offered on the website (e.g., credit card, TWINT, invoice). The provider reserves the right to exclude individual payment methods without giving reasons.
4. Delivery and performance
The place of performance is the provider's registered office, unless otherwise agreed.
Delivery times are non-binding unless they have been confirmed in writing as binding.
If a product is not available, the customer will be informed immediately.
5. Retention of title
The delivered goods remain the property of the supplier until full payment has been received.
6. Right of withdrawal/right of return
Note for Switzerland: Unlike in the EU, there is no statutory right of withdrawal in online trading in Switzerland, unless the supplier grants it voluntarily.
A right of return only exists in the case of defects or after prior written agreement.
(Optional: We grant a voluntary right of return of [X] days, provided that the goods are in their original packaging and undamaged.)
7. Warranty and liability
The provider provides warranty by remedying defects (repair) or replacement delivery. Rescission and reduction are excluded.
Liability for slight negligence, indirect damage, or consequential damage (e.g., loss of profit) is excluded to the extent permitted by law.
The provider accepts no liability for links to third-party websites.
8. Data protection
Personal data is processed in accordance with the separate privacy policy, which can be viewed on the website.
9. Final provisions and place of jurisdiction
Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
Swiss law applies.
The place of jurisdiction is the registered office of the provider, unless there is a mandatory legal place of jurisdiction (e.g., for consumer contracts).
